Terms of Service

Welcome to [MakeASpark] ("we," "our," or "Service"), a Hong Kong-based online dating website and mobile app operated from New Territories, HK. These Terms of Service ("Terms") govern your access to and use of our Service. By registering, subscribing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Geographic Scope & Eligibility

  • HK Only: Service is exclusively for individuals 18+ who are Hong Kong residents or physically located in Hong Kong (e.g., UK citizens working/traveling in HK).
  • Verification: HK phone number (+852) required for signup. Non-HK access may be blocked.
  • Confirmation: You must checkbox: "I confirm HK residency/location and accept HK law governs." Violations result in immediate account termination.

2. User Accounts

  • Provide accurate info (name, DOB, photos). You control your profile; we may remove fake/inappropriate content.
  • Keep password secure. You are responsible for all activity under your account.
  • Termination: We may suspend/ban for breaches (e.g., harassment, spam).

3. Subscription & Payments

  • Free Tier: Basic matching/messaging.
  • Premium: Auto-renewing via Stripe (HKD). Cancel anytime in settings.
  • No refunds except as required by HK law. Prices on site.

4. User Conduct & Content

Allowed: Authentic profiles, respectful messaging, genuine dating intent.
Prohibited:

  • Harassment, hate speech, nudity, scams.
  • Multiple fake accounts, commercial solicitation.
  • Automated bots, scraping.
    You grant us a worldwide, non-exclusive license to host/display your profile/photos for matching. You retain ownership; delete anytime.

5. Service Limitations

  • "AS IS": No warranties for matches, uptime, or results. Dating success not guaranteed.
  • No liability for user interactions/offline meetups. Meet safely.
  • Force majeure: Outages from HK typhoons, etc.​

6. Intellectual Property

Our trademarks (MakeASpark logo, #4f0f69 branding), code, design are proprietary. Do not copy.

7. Termination

  • You: Delete account anytime (data retained 12 months per Privacy Policy).
  • Us: Immediate termination for violations, no refund.

8. Limitation of Liability

To maximum extent under HK law: No liability for indirect damages. Max claim: HKD 100 or subscription fee paid.

9. Governing Law & Disputes

  • HK Law: Exclusive jurisdiction of Hong Kong courts (New Territories).
  • No class actions. Binding arbitration in HK for disputes under HKD 50k.
  • Complaints: First contact makeaspark.today@gmail.com; escalate to HK Consumer Council.

10. Changes

We may update Terms (30 days notice via email/site). Continued use = acceptance.
